Most construction disputes begin long before a lawsuit is ever filed. What can make a modern dispute different is that a routine construction defect may not stay simply a construction defect. Across building types, from offices, apartments, and condominiums to schools, hotels, retail, and industrial spaces, issues that began as building problems can turn into bodily injury claims by the people who occupy those buildings. A construction issue that once would have amounted to nothing more than a punch-list item or a warranty callback can escalate into an occupant-health complaint, a regulatory inquiry, and ultimately a claim that names every party connected to the project. These claims can be complex; a claimant who brings a lawsuit alleging a bodily injury claim will require expert testimony to prove that the alleged property condition caused the claimed bodily injury. HVAC Performance and Indoor Air Quality
Mechanical systems do far more than keep a building comfortable; they govern the air its occupants breathe. Ventilation rates, filtration levels, humidity control, and the relationships between supply and exhaust are not merely comfort features. They are health-and-safety functions frequently addressed by code and recognized standards such as ASHRAE Standards 62.1 and 62.2 for ventilation and acceptable indoor air quality.
A contractor or subcontract installing an HVAC system can best reduce risk of claims by commissioning, retaining testing-and-balancing reports, and requiring written documentation of any approved deviation from design. These checks help ensure the HVAC system is properly installed, balanced, or commission HVAC system. A system that is not properly installed might continue to function but with lesser quality air, which might lead to complaints associated with poor air quality or inadequate ventilation. All substitutions should be approved and documented to ensure that necessary safety and quality specifications—such as low-VOC products, formaldehyde-free composites, or specific fire-rated assemblies—are maintained. Substitutions made without a documented submittal and the approval of the owner or design professional tend to support the claimant’s position. By contrast, a disciplined submittal and substitution-request process creates the record demonstrating that the installed work conformed to what was actually approved.
Accessibility Deficiencies and Disability Claims
Accessibility deficiencies occupy a distinct position in the risk landscape because they can give rise to claims even where no physical injury has occurred. Most commercial, public, and multifamily buildings are subject to accessibility requirements, including public accommodations and commercial facilities under the Americans with Disabilities Act (“ADA”) and covered dwellings under the Fair Housing Act (“FHA”). These requirements serve a population that inevitably includes individuals with disabilities.
For example, the ADA and FHA or their state and local counterparts may set forth accessibility requirements for ramps, building entrances, door weight, and more. Deviations from approved drawings should be documented and approved to ensure any such requirements are captured. Furthermore, field verification of accessibility dimensions against the approved drawings before closeout, along with documentation of that verification, meaningfully reduces the exposure that arises when compliance is simply assumed rather than confirmed.
Documentation as the Decisive Factor
A single thread runs through each of these categories: the outcome of the eventual dispute is generally determined by what was recorded and who notified the parties before the dispute arose. Documentation, in this context, is not paperwork generated for its own sake. It preserves the record of jobsite conditions while accounts are still contemporaneous and motives remain neutral.
Requests for Information that surface a problem early, submittals that capture approvals, inspection reports that confirm covered work, and correspondence escalating a concern to the owner and design team are frequently what distinguish a defensible position from a dispute over conflicting memories years later.
Communication carries comparable weight. Many of the most significant claims arise not because a contractor disregarded a problem but because a problem was identified, raised informally, and never confirmed in writing or advanced through the proper channels. Where a defect is involved that could escalate into or be framed as a health issue, the need to identify and address the problem quickly is greater. Notifying the owner of a moisture concern, a ventilation anomaly, or a proposed material substitution is not an admission of fault. It converts individual awareness into shared responsibility and is often what keeps a contractor from becoming a named party in an eventual lawsuit.
Aligning Risk Management with Legal Exposure
In sum, design and construction professionals can help manage these risks by addressing them duringconstruction. Moisture, mechanical, materials, and accessibility checkpoints can be incorporated directly into a project’s quality program. Commissioning and testing can be performed, and the resulting reports should be retained. Material substitutions can be routed consistently through the submittal process.
When a condition appears deficient, documenting it in writing to the parties who need to know preserves the very record that will later govern the dispute.
